40-year-old man arrested for marrying an underage girl

Kwale - Police officers in Kwale on Sunday arrested a 40-year-old man at Makwang’ani village, Kubo south, for allegedly marrying a 14-year-old girl from Kitui County.
Kwale County commissioner, Evans Achoki confirmed the arrest of James Kisilu and said they are still doing investigations into the matter.
Speaking to the media in Kwale on Monday, Achoki said the suspect and the minor are being held at Kwale police station.
“We have arrested the man and rescued the minor. On Monday, age assessment will be done on the girl to ascertain how old she is,” he said.
Achoki said that the suspect will be taken to court once investigation into the matter is complete.
He said it is against children rights to marry an underage girl.
“The girl did her KCPE in 2014 and is supposed to be in secondary school like other students but her dream was shattered by early marriage,” said a resident.

She is said to have been married two months ago by the man who divorced his wife who had born him two children three years ago.
The minor was trafficked from Kitui to Kwale County by her parents after agreements were made between the two families.
Sources said that the minor admitted she was underage during interrogation before she was rescued from the marriage.
Majimboni location Chief, Matano Nzula said that the girl is below 18 years.
“She has not obtained a national identity card,” noted the chief.
The chief said that he had already communicated with the minor's parents in Kitui over the mater although they were not cooperative.
“They seem to have been angered because we are following up on the matter and we feel there is something they are hiding,” noted the chief.
The law imposes stiff penalties to anyone who gets engaged or betrothed to a person under the age of 18 years, which is the legal age of consent.
