21-year-old gets 30 years for defilement

Kisumu - A 21-year-old man has been sentenced to a 30 year jail term after a Nyando court found him guilty of defiling a 12-year-old minor.
Nyando Senior Principal Magistrate, Dorah Chepkwony found Dennis Elijah guilty of committing the offense on April 14, 2014 at Chemelil location in Muhoroni sub-County.
The magistrate declared in her judgment that the offense was contrary to Section 8 (1) (A) of the Sexual Offenses Act No. 3 of 2006 and ordered the convict to serve his term at Kodiaga GK Prison.
In mitigation, Elijah pleaded with the court for leniency saying he was too young and from a poor background and his future would be ruined if jailed.
But Chepkwony reminded him that though he was a first offender and from a poor family, the offense he committed was very grave.
“Your prayer for leniency cannot be answered since my hands are tied considering that the penalty against this serious offense is clearly spelt out in the law,” she declared.
Elijah was given 14 days' window within which to appeal against the sentence.
