The fate of two suspects facing eight counts who were arraigned in court for allegedly stealing Nokia Siemens Networks and Essar Telkom Kenya (YU) properties worth millions shillings will be known on 18 April 2012 when Malindi court set their case to be mentioned.
Charles Njoroge Mbugua and Daniel Otieno Okebe appeared before Principal Magistrate Laban Shiundu and pleaded not guilt to all eight charges.
In the first count they were charged that on diverse dates between April 12 and 14 at Gede , Watamu in Malindi district within Kilifi county with others not before court, stole 8 pieces of back up batteries all valued at 200,000 properties of Nokia Siemens Net Works.
The court further heard that on diverse dates between 29 March 14 and April 2012 in the second count at Madunguni, Malindi district the two suspects with others not before court stole 2 pieces of 70 mm 250 meters tower earth cables and rectifier module all valued at 150,000 shillings properties of Nokia Siemen Networks.
They were also charged in third count that on diverse dates between 13 April 2012 and 15 April at Msabaha in Malindi district, jointly with others not before court stole 4 pieces of back up batteries valued at 80,000 shillings being properties of Nokia Siemen Networks.
The two suspects faced a fourth count stealing 4 pieces of back up batteries valued at 80,000 shillings properties of Nokia Siemen Networks on diverse dates between 11 April and 15 April 2012 at Ngomeni in Malindi district jointly with other not before court.
In the fifth count the two suspects jointly with other not before court are alleged to have stolen 8 pieces of back up batteries and 3 rectifier modules all valued at 356,800 shillings being properties of Esser Telecom Kenya (YU) on diverse dates between 12 and 15 April 2012 at Ngomeni in Malindi district.
Charles Njoroge and Daniel Otieno Okebe also faced a sixth count of stealing 4 pieces of back up batteries jointly with others not before court valued at 118,400 shillings properties of Esser Telcom Kenya (YU) at on Gede in Malindi district on diverse dates between 12 and 15 April 2012.
In the seventh count the two suspects, on diverse dates between 12 and 15 April 2012 at Msabaha in
Malindi district jointly with others not before court stole 4 pieces of back up batteries valued at 118,400 shillings being properties of Esser Telecom Kenya (YU).
And on the eighth and the last count the two were charged that on diverse dates between 10 and 15 April 2012 at Kibokoni in Malindi district jointly with others not before court stole 4 pieces of back up batteries valued at 118,400 shillings being properties of Esser Telecom Kenya (YU).
Prosecutor Paul Nyamai urged the court to remand the two accused at Malindi police station for three days since investigation into the matter was not complete.
“I urge the court to remand the two suspects at Malindi police station for three days because prosecution side has not completed its investigation into the matter,” he applied.
Principal Magistrate Laban Shiundu considered application made by prosecutor Nyamai and said the two suspects will be remanded at Malindi [police station custody for three days for prosecution side to complete its investigations.
“In that case I have considered application made by prosecution side to remand the accused persons at Malindi police station for three days until investigations are complete. Therefore for that reason their case will be mention on 18 April 2012,” ordered Principal Magistrate Shiundu.
